Brian Ward Appraisal ("we," "us," or "our") is a residential real estate appraisal firm based in San Diego, California. This Privacy Policy describes what information we collect, how we use it, who we share it with, and your rights regarding that information. It applies to our website at www.brianward.com and to the appraisal services we provide.

1. Information We Collect

We collect information in two ways: information you provide to us directly, and information collected automatically when you visit our website.

Information you provide. When you submit our contact form or communicate with us by phone or email, we collect the information you share, which typically includes your name, email address, phone number, property address, and the type of appraisal you need. When you engage us for appraisal services, we also collect property details, legal documents, and other information necessary to complete the appraisal.

Information collected automatically. Our website is hosted on Cloudflare Pages. Cloudflare collects basic server-side analytics, including your IP address, browser type, pages visited, and the date and time of your visit. This data is collected at the server level for performance and security purposes. We do not use Google Analytics or any third-party tracking scripts on our website.

2. How We Use Your Information

We use the information we collect to respond to your inquiries, provide appraisal services, deliver your appraisal report, process payments, communicate with you about your appraisal, maintain our business records as required by professional standards, comply with legal and regulatory obligations, and protect the security of our website.

We do not use your information for marketing purposes, and we do not sell or rent your personal information to anyone.

3. USPAP Confidentiality

As licensed appraisers, we are bound by the Confidentiality section of the Ethics Rule in the Uniform Standards of Professional Appraisal Practice (USPAP). This means we treat all information gathered during an appraisal assignment as confidential, including the client's identity, the property being appraised, and the results of the appraisal.

We will not disclose confidential appraisal information except in the following circumstances: with the authorization of the client, to persons specifically authorized by the client, to third parties as required by law (such as a court order or subpoena), to state appraiser regulatory agencies conducting official investigations, or to other duly authorized authorities acting under applicable law.

This professional confidentiality obligation survives the completion of the appraisal assignment and applies in addition to the protections described in this Privacy Policy.

4. Third-Party Services

We use a limited number of third-party services to operate our business. Each handles your data only as needed to perform its specific function:

  • Cloudflare hosts our website and provides security and performance services. Cloudflare may set functional cookies (such as __cf_bm) for bot management and security. These are not used for advertising or tracking. Cloudflare Privacy Policy
  • Resend processes emails submitted through our contact form. When you submit the form, your name, email address, and message are transmitted through Resend's email API so that we receive your inquiry. Resend Privacy Policy
  • Square processes payments for appraisal services. Payment transactions are handled through Square's platform, not through our website. Square Privacy Policy
  • Google Workspace provides our business email and file storage. Correspondence you send to contact@brianward.com is stored in Google Workspace. Google Privacy Policy

Our website may also contain links to external websites. We are not responsible for the privacy practices of those sites.

5. Cookies

Our website does not use cookies for advertising, analytics, or user tracking. The only cookies that may be set are functional cookies placed by Cloudflare for security and performance purposes, such as bot detection. These cookies are necessary for the website to operate properly and cannot be used to identify you personally. We do not use Google Analytics or any third-party tracking pixels.

6. Data Security

We take reasonable measures to protect your information, including using HTTPS encryption for all website traffic, storing business records in access-controlled cloud services, and limiting access to client information to authorized personnel. No method of transmission over the internet is completely secure, but we work to protect your information using industry-standard practices.

7. Data Retention

We retain appraisal records, workfiles, and related client information for a minimum of five years following the completion of the appraisal, as required by USPAP Record Keeping Rule. Contact form submissions and general correspondence are retained for as long as reasonably necessary to provide our services and maintain our business records. When information is no longer needed and no retention obligation applies, we securely dispose of it.

8. Your Privacy Rights

You have the right to request access to the personal information we hold about you, ask us to correct inaccurate information, and request deletion of your information where no legal or professional retention requirement applies. To exercise any of these rights, contact us using the information at the bottom of this page. We will respond to your request within 30 days.

9. California Privacy Rights (CCPA)

If you are a California resident, the California Consumer Privacy Act (CCPA) provides you with additional rights regarding your personal information.

Right to Know. You have the right to request that we disclose the categories and specific pieces of personal information we have collected about you, the categories of sources from which that information was collected, the business purpose for collecting it, and the categories of third parties with whom we share it.

Right to Delete. You have the right to request that we delete the personal information we have collected from you, subject to certain exceptions. We may deny a deletion request if retaining the information is necessary to complete a transaction or provide a service you requested, comply with a legal obligation such as USPAP record-keeping requirements, or exercise or defend legal claims.

Right to Opt-Out of Sale. We do not sell your personal information and have not sold personal information in the preceding 12 months.

Right to Non-Discrimination. We will not discriminate against you for exercising any of your CCPA rights.

10. Children's Privacy

Our website and services are not directed to individuals under the age of 18. We do not knowingly collect personal information from children. If we learn that we have collected information from a child, we will take steps to delete it promptly.
